Q1 of 20 Licensing & Regulation

The Governor is filling one of the WREC seats reserved for real estate licensees. The nominee has been licensed and active in Wyoming for 3 years. Does the nominee qualify for that seat?

  1. No, that seat requires 10 years of Wyoming licensed experience
  2. Yes, provided the Wyoming Senate confirms the nominee
  3. No, that seat requires 5 years of Wyoming licensed experience
  4. Yes, any actively licensed Wyoming salesperson or broker qualifies
Show answer & explanation

Correct: C No, that seat requires 5 years of Wyoming licensed experience

W.S. 33-28-105(a) provides that "not less than three (3) or more than four (4) of the membership shall have been engaged in business as a licensee in Wyoming for at least five (5) years immediately preceding appointment." A nominee with only 3 years does not qualify for one of those licensee seats, and Senate confirmation cannot cure a statutory qualification defect. Two details matter: the experience must be Wyoming experience, and it must fall in the 5 years immediately preceding appointment. Also note the 5-year rule reaches only the 3 to 4 licensee seats - because no more than four members may be 5-year licensees, at least one of the five seats must always go to someone who is not.

Q2 of 20 Licensing & Regulation

Which Wyoming license type may operate independently, without being licensed under another broker?

  1. Any licensee with five years of experience
  2. Associate broker
  3. Responsible broker
  4. Salesperson
Show answer & explanation

Correct: C Responsible broker

Only a responsible broker operates independently. W.S. 33-28-102(b)(xlix) defines a responsible broker as one who supervises the licensees of a real estate company or who operates a single license office or sole proprietorship. Both other individual license types are supervised: a salesperson "is licensed by the commission under a responsible broker" (33-28-102(b)(li)), and an associate broker likewise "is licensed by the commission under a responsible broker and does not have supervisory responsibilities" (33-28-102(b)(iv)). Holding a broker-level license alone is therefore not enough to practice independently in Wyoming.

Q3 of 20 Licensing & Regulation

A salesperson's association with their responsible broker is terminated. What must happen?

  1. The salesperson automatically becomes an independent broker
  2. The salesperson may keep working for 30 days while finding a new broker
  3. The responsible broker must immediately notify WREC, and the salesperson may not perform real estate activity
  4. No notice is required until the salesperson affiliates with a new broker
Show answer & explanation

Correct: C The responsible broker must immediately notify WREC, and the salesperson may not perform real estate activity

W.S. 33-28-109(c) requires that 'upon termination of an associate broker's or salesperson's association or contractual relationship, his responsible broker shall immediately notify the commission for cancellation of the associate broker's or salesperson's license.' The salesperson's license may be held on a 'hold for transfer' basis for no more than 30 days before it automatically becomes inactive, and WREC Chapter 1, Section 5(c) is clear that a license that is inactive or on hold for transfer may not be used to perform any real estate activity. The salesperson also may not associate with a new responsible broker until a license is issued under that broker.

Q4 of 20 Licensing & Regulation

Which practice is explicitly prohibited in Wyoming real estate transactions?

  1. Dual agency representation
  2. Transaction brokerage
  3. Exclusive buyer agency
  4. Seller-only representation
Show answer & explanation

Correct: A Dual agency representation

Wyoming expressly bans dual agency: W.S. 33-28-302(o) states that 'a licensee shall not establish dual agency with any seller or buyer,' and 33-28-302(k) allows a licensee to be an agent for the seller or for the buyer 'but not as an agent for both.' Exclusive buyer agency (33-28-304) and seller-only agency (33-28-303) are both permitted, and Wyoming's version of transaction brokerage — the non-agency 'intermediary' relationship of 33-28-305 — is the lawful way for one licensee, or two designated licensees in the same company, to assist both sides. Only dual agency itself is prohibited.

Q5 of 20 State Practice

A Wyoming buyer hires a licensee as their agent. Which duty does the agent owe?

  1. Disclosure of material facts only
  2. Honesty and fair dealing only
  3. Accounting and confidentiality only
  4. Full fiduciary duties
Show answer & explanation

Correct: D Full fiduciary duties

Under W.S. §33-28-304(a), a licensee engaged by a buyer must perform the written agreement, exercise reasonable skill and care, and promote the buyer's interests with 'utmost good faith, loyalty and fidelity' — including presenting all offers timely, disclosing adverse material facts actually known, counseling on known material benefits and risks, and accounting timely for money and property. Wyoming reserves this level of duty for agency: §33-28-305(b)(ii)(K) requires an intermediary to disclose that an intermediary 'owes no fiduciary duty either to buyer or seller.' (Note: §33-28-301 was repealed in 2011; the agent duty lists are §33-28-303 for seller's agents and §33-28-304 for buyer's agents.)

Q6 of 20 State Practice

When must a Wyoming licensee make the written brokerage relationship disclosure to a prospective buyer?

  1. Within 48 hours of the first showing
  2. Before any discussion incidental to a sale or lease
  3. At the time of the first written offer
  4. At closing or settlement
Show answer & explanation

Correct: B Before any discussion incidental to a sale or lease

W.S. 33-28-306(a) requires a written disclosure of applicable agency, intermediary or customer relationships before engaging in any discussion or arrangement incidental to a sale, purchase, exchange or lease, and before entering into any written agreement. The same subsection expressly provides that open house showings, preliminary conversations and requests for factual information do NOT constitute such discussions, so casual property talk alone does not trigger the duty.

Q7 of 20 State Practice

A Wyoming broker receives earnest money on Friday afternoon. By when must it be deposited?

  1. Within 48 hours of receipt
  2. Within 3 business days
  3. The next banking day
  4. By the following Friday
Show answer & explanation

Correct: C The next banking day

Wyoming requires trust funds to be deposited no later than the first banking day after receipt. If received Friday afternoon, the deposit must be made by Monday (assuming Monday is a banking day). This is stricter than most states' deposit timelines.

Q8 of 20 State Practice

A Wyoming salesperson posts a property listing on social media using only her personal name. What violation has occurred?

  1. A blind ad without broker identification
  2. Using an unapproved marketing platform
  3. Failure to obtain a social media license
  4. Advertising without a written contract
Show answer & explanation

Correct: A A blind ad without broker identification

W.S. 33-28-119(g) bars a salesperson from advertising real estate without including the real estate company name under which she is licensed, and WREC Rules Ch. 6 Section 4 applies that requirement to every advertisement 'displayed digitally or in print' — social media included. A post carrying only her personal name is a blind ad. Note that a trade name or team name never substitutes for the company name; Ch. 6 Section 4(a) requires the licensed company name to appear concurrently with it.

Q9 of 20 State Practice

A local real estate association publishes a suggested commission rate schedule for all member brokers. What type of violation does this represent?

  1. A breach of fiduciary duty
  2. Antitrust price-fixing
  3. An unauthorized practice of law
  4. A WREC advertising violation
Show answer & explanation

Correct: B Antitrust price-fixing

Setting or suggesting commission rates among competing brokers constitutes price-fixing, a per se violation of federal antitrust law. Commission rates must always be freely negotiable between the broker and the client. No organization may establish standard rates.

Q10 of 20 State Practice

What is the minimum E&O insurance coverage required per claim for Wyoming licensees?

  1. $500,000 per claim
  2. $100,000 per claim
  3. $250,000 per claim
  4. $50,000 per claim
Show answer & explanation

Correct: B $100,000 per claim

WREC Rules & Regulations Chapter 7 set the minimum errors and omissions coverage at $100,000 single-limit liability per occurrence or claim made (§ 4(a) — not including costs for investigation or defense) with a $500,000 annual aggregate (§ 4(b)). Section 8(a)(iii)(D) applies the same $100,000 / $500,000 floor to individually obtained 'equivalent' coverage. The mandate itself comes from W.S. 33-28-401, effective January 1, 2008, but the statute sets no dollar limits — subsection (c) directs the Commission to fix the minimum limits, deductible, and exemptions by rule.

Q11 of 20 State Transactions

How is Wyoming's real estate recovery account funded?

  1. Annual appropriations from the general fund
  2. A $20 fee from each license issuance or renewal
  3. A one-time $100 fee at initial licensure only
  4. A percentage of each commission earned
Show answer & explanation

Correct: B A $20 fee from each license issuance or renewal

Wyoming funds its recovery account through a $20 fee collected every time a person obtains or renews a real estate license. The fee is not based on commissions, general fund appropriations, or a one-time charge.

Q12 of 20 State Transactions

A Wyoming landlord asks what the maximum security deposit is under state law. The correct answer is:

  1. Three months' rent for furnished units
  2. There is no statutory maximum in Wyoming
  3. Two months' rent for all rental units
  4. One month's rent for unfurnished units
Show answer & explanation

Correct: B There is no statutory maximum in Wyoming

Wyoming does not impose a statutory cap on security deposit amounts. This is one of several provisions that make Wyoming considered landlord-friendly. The amount is left to negotiation between landlord and tenant.

Q13 of 20 State Transactions

Which foreclosure methods are available in Wyoming?

  1. Strict foreclosure without any sale
  2. Judicial and non-judicial foreclosure
  3. Only non-judicial foreclosure methods
  4. Only judicial foreclosure methods
Show answer & explanation

Correct: B Judicial and non-judicial foreclosure

Wyoming permits both judicial foreclosure through court proceedings with a sheriff sale, and non-judicial foreclosure using the power of sale clause. The method depends on the terms of the security instrument.

Q14 of 20 State Transactions

What is the primary method of land description used in Wyoming?

  1. Rectangular (government) survey system
  2. GPS coordinate-based descriptions
  3. Metes and bounds descriptions
  4. Lot and block from recorded plats
Show answer & explanation

Correct: A Rectangular (government) survey system

Due to Wyoming's vast open geography and western settlement patterns, the rectangular (government) survey system using townships and ranges is the primary method of land description. Metes and bounds is used in some areas but is not the dominant method.

Q15 of 20 Licensing & Regulation

At minimum, how many of the five WREC commissioners must have been engaged in business as a Wyoming real estate licensee for the 5 years immediately preceding appointment?

  1. At least 4 commissioners
  2. At least 3 commissioners
  3. At least 2 commissioners
  4. All 5 commissioners
Show answer & explanation

Correct: B At least 3 commissioners

W.S. 33-28-105(a): "Not less than three (3) or more than four (4) of the membership shall have been engaged in business as a licensee in Wyoming for at least five (5) years immediately preceding appointment." Three is the floor and four is the ceiling, so at least one of the five seats must always be filled by someone who is not a 5-year Wyoming licensee. Note the statute tests prior business experience as a licensee in the 5 years before appointment, not whether the member holds an active license while serving.

Q16 of 20 Licensing & Regulation

A property owner pays a friend $500 to find a tenant for a rental property. The friend is unlicensed. Is this legal in Wyoming?

  1. Yes, payments under $1,000 are exempt
  2. No, leasing for compensation requires licensure
  3. Yes, friends are exempt from license laws
  4. Yes, residential rentals are always exempt
Show answer & explanation

Correct: B No, leasing for compensation requires licensure

Wyoming law requires a real estate license for anyone who engages in listing, selling, buying, exchanging, leasing, or property management for compensation. Receiving $500 to find a tenant is leasing for compensation and requires licensure, regardless of the personal relationship.

Q17 of 20 Licensing & Regulation

A salesperson changes broker affiliations. What notification must occur?

  1. The salesperson files with Pearson VUE
  2. Only the new broker files with the county
  3. WREC must be notified of the change
  4. No notification is required
Show answer & explanation

Correct: C WREC must be notified of the change

When a salesperson changes broker affiliation in Wyoming, WREC must be notified of the change. This ensures the commission maintains accurate records of which licensees are affiliated with which brokers, which is essential for supervision accountability and consumer protection.

Q18 of 20 Licensing & Regulation

A broker deposits a client's earnest money into the broker's personal checking account. What violation has occurred?

  1. Unauthorized dual agency
  2. Practicing without a license
  3. Commingling of trust funds
  4. Failure to maintain E&O insurance
Show answer & explanation

Correct: C Commingling of trust funds

Depositing client funds into a personal account constitutes commingling, which is a serious violation of Wyoming real estate law. Client funds must be deposited into a properly maintained trust or escrow account, kept separate from the broker's personal or business operating funds.

Q19 of 20 State Practice

A seller contacts a brokerage but does not sign a listing agreement. What relationship exists?

  1. Intermediary relationship
  2. Customer relationship
  3. No legal relationship exists
  4. Agent relationship
Show answer & explanation

Correct: B Customer relationship

Under W.S. §33-28-302(p), a customer relationship exists by default 'unless a single agency or intermediary relationship is established through a written agreement.' A customer is not a client, but Wyoming does not leave a customer with nothing: §33-28-310(a) requires reasonable skill and care, timely presentation of all offers, timely accounting, keeping the parties fully informed, and disclosure of adverse material facts actually known. What a customer is NOT owed is agency-level loyalty and fidelity — and §33-28-302(p) states flatly that a licensee 'shall not owe any duty of confidentiality to a customer.'

Q20 of 20 State Practice

A Wyoming licensee shows a home at an open house to a walk-in buyer and answers factual questions, but provides no relationship disclosure. What is the result?

  1. No violation; showings and factual questions are exempt
  2. A violation, because any showing triggers disclosure
  3. A violation unless disclosure follows within 48 hours
  4. A violation, because the buyer became a client
Show answer & explanation

Correct: A No violation; showings and factual questions are exempt

W.S. 33-28-306(a) expressly provides that open house showings, preliminary conversations and requests for factual information do not constitute discussions or arrangements incidental to a sale, purchase, exchange or lease. The written relationship disclosure is triggered by a discussion or arrangement incidental to a transaction, or by entering a written agreement. A person who attends a showing without an agency relationship is a 'customer' under W.S. 33-28-102(b)(xiii), and W.S. 33-28-306(a)(vii)(A) requires the disclosure to state that a customer cannot be required to sign an agency agreement just to view or tour real estate.

About the exam

More about the Wyoming real estate exam

The Wyoming real estate salesperson exam trips up more first-time candidates than they expect. You have to pass the national and Wyoming portions on their own, so a strong national score won't make up for a weak showing on Wyoming law, and that is where unprepared candidates lose the most points. That makes Wyoming-specific preparation matter as much as the national material.

Wyoming tests the powers and disciplinary process of the Real Estate Commission, the Real Estate Recovery and Education Fund, the rules that govern how licensees advertise and handle documents and money, the agency relationships and disclosures a salesperson owes the parties, and mandatory errors and omissions insurance. None of that looks like the material a candidate in a neighboring state studies. A generic real estate practice test won't cut it. You need Wyoming-specific practice questions.

FAQ

Wyoming real estate exam: your questions answered

How many questions are on the Wyoming real estate exam?

The Wyoming salesperson exam has 120 scored multiple-choice questions, split into an 80-question national portion and a 40-question Wyoming portion. A handful of unscored pretest questions are mixed in that don't count toward your result. Pearson VUE administers it for the Wyoming Real Estate Commission, and a first-time candidate has to pass both portions to get licensed.

What's the passing score for the Wyoming real estate exam?

Wyoming reports your result as a scaled score from 0 to 100, with 75 set as the passing score on each portion. A scaled 75 reflects how your performance compares across different versions of the exam rather than a flat 75% of the questions correct. The national and Wyoming portions are scored separately, so you have to clear both.

How much does the Wyoming real estate exam cost?

The examination fee is $80 per portion at a Pearson VUE test center, so a first-time candidate sitting both the national and Wyoming portions pays $160 in total. Testing through OnVUE online proctoring instead runs $90 per portion. The fee is paid to Pearson VUE when you reserve your seat and isn't accepted at the test center.

How long is the Wyoming real estate exam?

You get 2.5 hours for the 80-question national portion and 1.5 hours for the 40-question Wyoming portion, four hours in all. First-time candidates take both portions, and you leave the test center with an official score report marked pass or fail.

Who administers the Wyoming real estate exam?

The Wyoming Real Estate Salesperson Examination is administered by Pearson VUE for the Wyoming Real Estate Commission. You register and schedule your exam date through Pearson VUE.

Is the Wyoming real estate exam hard?

It is challenging, and the Wyoming portion is where most candidates slip. Many handle national topics like financing and valuation well, then underestimate how much Wyoming-specific law the 40-question state portion packs in across Commission powers, licensee conduct rules, and agency disclosures. Because you pass or fail each portion on its own, a strong national score can't rescue a weak state score. Focused practice on Wyoming law is what separates first-time passers from retakes.

What's on the Wyoming real estate salesperson exam?

The 80-question national portion covers real property characteristics and land use, forms of ownership and transfer of title, property value and appraisal, contracts and agency, the practice of real estate, property and environmental disclosures, financing and settlement, and real estate math. The 40-question Wyoming portion focuses on the powers of the Real Estate Commission, the rules that govern licensee activities like advertising and the handling of documents and money, agency relationships and disclosures, the Real Estate Recovery and Education Fund, and additional topics like land description, landlord and tenant law, foreclosure and redemption, and broker price opinions.

What's the best way to prepare for the Wyoming real estate exam?

After you finish your pre-license coursework, the highest-leverage thing you can do is drill Wyoming-specific practice questions and review the explanation on every miss. Generic national practice tests help with principles but won't catch you on Wyoming's Commission rules, agency disclosures, and the Real Estate Recovery and Education Fund. The RealReady app gives you the full Wyoming question bank, plus a missed-question mode and per-category progress tracking so you can target your weak spots. Most users study 30 to 60 minutes a day for a few weeks before sitting the exam.

Is RealReady free?

The 20 Wyoming practice questions on this page are free, no account or signup needed. Unlocking the rest of the Wyoming bank is a single in-app purchase you pay once and own, with no recurring charge and no time limit on access.

Does RealReady cover the Wyoming real estate exam?

Yes. RealReady has a dedicated Wyoming question bank built for the Wyoming real estate exam, covering the national principles every candidate sees plus the Wyoming law that trips people up, like the powers of the Real Estate Commission, the Real Estate Recovery and Education Fund, and mandatory errors and omissions insurance.

Is RealReady a real estate license course?

No. RealReady is exam practice, not a pre-license course, so it doesn't count toward Wyoming's required pre-license education hours. Use it after or alongside your coursework to drill realistic practice questions and find your weak spots before exam day.
